I have examined the accompanying Ordinance entitled

"An Ordinance for the Incorporation of the Trustees of the

Union Church at Vietoria in this Colony."

and I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions, This is a private Ordinance. In 1845 a Dr. Legge of the Church Missionary Society raised public subscriptions and built a chapel. In 1863 the chapel was moved to Stanton Street. In 1866 Dr. Legge assigned the buil- ding and the ground on which it stood to trustees. In 1889 the chapel which by this time was known as the Union Church was again moved to its present site in Kennedy Road. There is nothing in any of the Crown Leases of the land on which the church stands limiting the purpose for which it may be used bæt section 5 of the Ordinance contains the limitation provided by the

original trust deed.
